What is the NJ Lead Safe Law?

The NJ Lead Safe Law requires landlords to ensure their rental properties are free from lead hazards and to obtain certification to confirm compliance. It is specifically aimed at reducing exposure to lead-based paint and dust, which can lead to serious health problems, especially in children under six years old.

Who is affected by this law?

The law applies to all rental properties in New Jersey that were built before 1978, as this is the year when lead-based paint was banned in residential properties. Landlords of these single or multi family rental properties are required to have their homes inspected and certified as "Lead Safe.”

Are there exemptions to this law?

Yes. If a property has already been certified as Lead-Free. Call us to find out if you can qualify to become lead free. Additionally, properties built after 1978 are exempt from these regulations since lead-based paint was banned in residential use after this year.

When are inspections needed?

Initial Inspections: When tenants move in, a lead inspection must be conducted.

Periodicity: Landlords must ensure an inspection is completed within three years of July 22, 2022 (by July 22, 2025)

Frequency of Certification: Inspections and certifications need to be renewed every three years.

Are there penalties for non compliance?

Landlords who fail to obtain the required certifications or do not conduct necessary inspections can be fined up to $1,000 per week until they comply with the law.
